These terms and conditions (the “Terms”) govern your use of the MtLocalGoodies website. By browsing the directory or listing a business on it, you accept these Terms. Please read them, and contact us at info@mtlocalgoodies.com if anything is unclear.

1. Who we are

MtLocalGoodies is an online directory of verified local businesses across Malta and Gozo, from shops and food makers to services and craft. It is a service operated by Lukasz Samelko, who is registered in Malta and provides MtLocalGoodies as part of his marketing services. References to “we”, “us” and “our” mean Lukasz Samelko, who operates in accordance with the laws of Malta and can issue VAT invoices for the service.

2. What MtLocalGoodies is, and is not

We are a directory. We help you discover verified local businesses and reach them directly. We are not a shop, an agent or a broker. We do not sell the goods or services listed, we do not take orders, we do not handle payment between you and a business, and we do not deliver anything. When you find a business you like, you contact it yourself, usually over WhatsApp or by phone, and you deal with that business directly.

This means any agreement to buy, book or arrange anything is made solely between you and the business. We are not a party to it, we make no promise on the business’s behalf, and we are not responsible for how the business performs.

3. Verification, and what it does and does not mean

We check the businesses we list so the directory stays trustworthy, and we mark verified storefronts accordingly. Verification means we have taken reasonable steps to confirm a business is real and locally based. It is not a guarantee of the quality, safety, pricing or availability of what that business offers. Always use your own judgement, just as you would with any local business you found by word of mouth.

4. Membership for businesses

Businesses join the directory by taking a membership. Our model is simple and stated up front:

• Membership is a flat fee for a storefront listing. We never take a cut of your sales and we charge no per-customer or per-enquiry fee.
• Current plans are a free basic listing, a Verified Storefront at €99 a year (or €12 a month), and a Founding Member rate of €59 a year for the first 100 businesses. The exact price and billing cycle that apply to you are confirmed at sign-up.
• Billing, cancellation and any refund terms for a membership are set out in our Refunds & Membership Billing policy.

If you list a business with us, you agree to:

• Give accurate, current information about your business, and keep your listing up to date.
• Only list a business you are entitled to represent, offering goods and services you may lawfully provide.
• Hold the rights to any text, photos or logos you upload, and grant us permission to display them as part of your listing while it is live.
• Deal fairly and lawfully with the customers who reach you through the directory.

We may refuse, edit or remove a listing that is inaccurate, unlawful, misleading or otherwise inconsistent with these Terms, and we will tell you why where we reasonably can.

5. Using the directory as a visitor

Browsing MtLocalGoodies is free. When you use the site, you agree to:

• Use it lawfully, and not misuse, disrupt or try to gain unauthorised access to it.
• Not scrape, copy or reuse the directory’s listings or data for your own commercial purposes without our permission.
• Understand that anything you go on to buy or arrange is between you and the business, on their terms, not ours.

6. Third-party businesses and content

Listings describe independent businesses that are responsible for their own information, goods, services, pricing and conduct. We present their details in good faith, but we cannot guarantee that every detail is complete, current or error-free, and we are not liable for the acts, omissions, products or services of any listed business. Any dispute about a purchase or booking is between you and that business.

7. Intellectual property

The MtLocalGoodies name and logo, the directory, and the site’s text, design and original graphics are owned by us or our licensors and protected by intellectual property law. Business listings include content owned by the businesses themselves. You may view and use the site for your own personal, non-commercial purposes. You may not copy, republish or exploit any part of it without our prior written permission.

8. Limitation of liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, we provide the directory “as is”, we are not liable for losses that were not reasonably foreseeable, for business losses, or for matters outside our reasonable control, and we are not liable for any dealing between you and a listed business. Where we are found liable to you in connection with the directory, our total liability will not exceed any membership fee you have paid us in the twelve months before the claim.

9. Governing law and dispute resolution

These Terms and any dispute arising from them are governed by the laws of Malta, and the courts of Malta have jurisdiction. We would always rather settle any issue amicably, so please contact us first at info@mtlocalgoodies.com. If you are a consumer, you keep the rights given to you by applicable EU and Maltese consumer protection law, which these Terms do not affect.

10. Changes to these Terms

We may update these Terms from time to time to reflect changes in the service or the law. The current version always carries the “last updated” date shown above, and continuing to use the site after a change means you accept the updated Terms.
